How do we begin the recovery process?
We will usually start with an initial letter and, dependent on the response, advise you on further action. Our contact frequently encourages the parties to communicate and mediate at an early stage to effect payment. Where this is not possible we shall discuss with you escalating the matter to Court or alternative insolvency action.
What if there is no response?
The initial letter with supporting evidence provides a 30 day response time. Where there is no response, Court Proceedings can be prepared or, if certain thresholds apply, insolvency action may be considered.
- Claim Form and Particulars of Claim at Court 14 days for Debtor to respond.
- If no response, Judgment in default can be applied for. In the event of a Defence or Admission, we shall discuss your options.
Judgment sent for enforcement in the event of none payment through Court Bailiff or High Court Enforcement Officer.
